BOWIE RESOURCES, LLC <br />Bowie No. 1 Mine <br />Coal Mine Waste Bank Inspection - 2nd Quarter 2007 <br />On June 22, 2007, I pertormed a quarterly visual inspection of the Bowie No. 1 Mine <br />coal mine waste bank in accordance with Rule 4.10.2. <br />I, J. E. Stover, P.E., have a wide variety of experience in the design and construction of <br />earth fill embankments. Nothing was observed during the inspection that would indicate <br />the pile has a potential for failure. The pile is basically filled to capacity. The pile and <br />surrounding areas were dry. No seepage or spoil springs were noted around the pile. <br />- - No.coal mine waste was-placed-in the_pile-during_the~uarter._There_we[e_no drainage___~ <br />alterations and no new bench construction. No topsoil was salvaged during the quarter. <br />The design of the waste disposal area is presented in Volume 6A. To the best of my <br />knowledge and belief, based on my inspection of the pile and previous inspections by <br />professional engineers, the coal mine waste bank has been constructed in accordance <br />with the approved plan. <br />The pile is located in a remote area well away from human habitation. A failure of the <br />pile might damage the mine haul road located below the pile.
