WHEREAS, [he Colorado Mined Land Reclamation Act, CAS. 1973, 3a-32-101 5S ysy. (the "Act"). as
amended, provides that no petnti[ may be issued under [he Act until the Mined Land Reclamation Board (the
"Board") receives a Financial Warranty (or Warranties) ss described in the Act.

California corporation, has applied for a permit to conduct a mining operation kalown as
Pitch Mine (dte "Operation"), on certain lands in Saguache Counn~,
Colorado. These lands are described in the permit application, as amended and Supplemented, and are referred
[o herein as the "Affected Lands".
