RE: Fruits No. 1 and 2 Mines (C-81-015), Annual Reclamation Report, Annual
Hydrology Report, and Pond~Inepection Reports.
Dear Mr. Lewicki:
The Division would like to confirm the receipt of your submittal of the 1992
Annual Reclamation Report for the Fruits Mines as required by Rule 2.04.13. The
submitted Annual Hydrology Report fulfills the requirements of Rule 4.05.13(4)(c)
as well.
Ae required by Rule 4.05.6(13) the Division needs a copy of the pond inspection
for 1992. Rule 4.05.6(13) states:
All sedimentation ponds shall be examined by a qualified registered
professional engineer or other qualified individuals under their
direction. The professional engineer or individual shall be experienced
in the construction of sedimentation ponds. Ponds shall be inspected for
structural weakness, erosion, and other hazardous conditions. The report
shall also include the level of the sediment in the pond and any other
required maintenance of the structure. These inspections shall be made
regularly during construction, upon completion of construction and, at a
minimum, on a quarterly basis thereafter. The report shall be retained at
or near the mine site and a copy of the report promptly submitted to the
Division on a quarterly or annual basis, as required by the Division, by
a registered professional engineer.
We are aware that during July 1991 American Shield believed an annual inspection
of the sediment pond was permissible. Ae stated above submittal of the reports
may be on an annual basis but, the inspections must be made quarterly. We
realize that this matter is confusing but the regulation is clear regarding the
frequency of inspections required.
