The <br />submitted Annual Hydrology Report fulfills the requirements of Rule 4.05.13(4)(c) <br />as well. <br />Ae required by Rule 4.05.6(13) the Division needs a copy of the pond inspection <br />for 1992. Rule 4.05.6(13) states: <br />All sedimentation ponds shall be examined by a qualified registered <br />professional engineer or other qualified individuals under their <br />direction. The professional engineer or individual shall be experienced <br />in the construction of sedimentation ponds. Ponds shall be inspected for <br />structural weakness, erosion, and other hazardous conditions. The report <br />shall also include the level of the sediment in the pond and any other <br />required maintenance of the structure. These inspections shall be made <br />regularly during construction, upon completion of construction and, at a <br />minimum, on a quarterly basis thereafter. The report shall be retained at <br />or near the mine site and a copy of the report promptly submitted to the <br />Division on a quarterly or annual basis, as required by the Division, by <br />a registered professional engineer. <br />We are aware that during July 1991 American Shield believed an annual inspection <br />of the sediment pond was permissible. Ae stated above submittal of the reports <br />may be on an annual basis but, the inspections must be made quarterly. We <br />realize that this matter is confusing but the regulation is clear regarding the <br />frequency of inspections required. <br />If you have any questions, please call me. <br />Sincerely, <br />H.
