The proposed removal and recompaction of the <br />substandard material is acceptable. <br />The approved permit does include allowances for the construction of an <br />enlarged west ridge waste pile. In fact, the approved life-of-pile plan <br />includes three phases or portions of the pile. The current piles <br />configuration represents Phase I. However, to avoid another unfortunate <br />oversight, I encourage you to remind Cyprus Orchard Yalley that the new <br />Phase II foundation area will require the inspection and certification of the <br />topsoil/subsoil removal and foundation preparation. It would be unfortunate <br />if they overlooked this critical step and once again had to rework disposed <br />material . <br />The operator also proposes to amend the plan for placement of material during <br />winter months. Briefly summarized, they propose to dump material loosely <br />during the winter and then rework and compact the material in less than <br />two foot thick lifts in the spring and summer. This would be acceptable if <br />Cyprus Orcftard Valley can demonstrate that adequate storage room exists to <br />accommodate the expected waste production and to feasibly accommodate <br />recompaction in the spring and Sumner. I recommend that you require <br />Cyprus Orchard Valley to project their expected volume of waste to be <br />generated during the winter months, and to develop a specific plan designating <br />the area to be used to accommodate loose dumped waste storage and to provide a <br />feasible methodology for recompaction in the spring and Sumner months. Other <br />mines with equal or worse meterological conditions, such as Mt. Gunnison #1 <br />and the Coal Basin Mines, complete successful compaction throughout the winter <br />months. Perhaps Cyprus Orchard Valley might learn from their experience by <br />visiting their facilities and observing their methodology. I do believe that <br />the proposed modification should be reviewed as a technical revision <br />application. <br />/ ern <br />2569E <br />
