As of the date of this letter the Division has not received your annual fee and report for July 13, 1995. Therefore, you are in Violation of the above cited statute and the provisions of your Permit No. M-90-041. Pursuant to C.R.S. 34-32-124 the Mined Land Reclamation Board hereby assesses Notice of Violation No. M-95-067, Civil Penalties in the amount of $225.00, and Notice and Order to Cease and Desist from ALL mining related activities associated with Permit PIO. M-90-041. NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED TO ANY OPEFtATOFt WHO IS CIIR.RENTLY FOIIND TO BE IN VIOLATION IN THIS STATE (C.R.S. 34-32-120) IINTIL THE VIOLATION IS ABATED. If you i:ail to submit your annual fee, annual report, and the Civil Penalties assessed to the Division by October 18, 1995, this matter will be heard at a Formal Public Hearing before the Mined Land Reclamation Board for consideration of permit revocation, and forfeit>>re of your financial warranties (Certificate of Deposit No. 16-228348-5 in the amount of $2,000.00 and Certificate of Deposit No. 16-~:50253-8 in the amount of $3,000.00), at the October 19, 1995 Board ME~eting. If you submit all past due annual fees, reports, and the Civi-1 Penalties by October 18, 1995, this matter will be withdrawn from Board consideration. IN ORDEF: TO AVOID PERMIT REVOCATION AND BOND FORFEITURE, PLEASE SUBMIT ;;225.00 FOR ANNUAL FEES DUE AND $225.00 FOR CIVIL PENALTIES (FOR A TOTAL OF $450.00), AND YOUR ANNUAL REPORT BY OCTOBER 18, 1995.
