BANTA, Director <br />February 25, 1988 <br />Mr. Jim Showalter <br />S & K Construction <br />576 County Road 100 <br />Craig, Colorado 81625 <br />REFERENCE: Mining Permit No. M-80-248, Breeze Basin Rock <br />Annual Fees and Annual Report <br />Dear Mr. Showalter: <br />We are in receipt of your letter of February 23, 1988, indicating that this <br />gravel operation has been turned over to Mr. Otis Lyons. A mining permit <br />cannot automatically be turned over to another party. If Mr. Lyons is the <br />person operating in this pit and Breeze Basin Rock is no longer involved, <br />a Succession of Operator request must be made to the Mined Land Reclamation <br />Board. We are holding a $2,500 financial warranty in the name of Breeze <br />Basin Rock to cover reclamation on this pit. In the event of a succession <br />of operator the new operator will need to provide a replacement financial <br />warranty in that same amount. <br />Until such time as a succession of operator is approved by the Mined Land <br />Reclamation Board, or reclamation responsibility is released by the Board, <br />Breeze Basin Rock and/or responsible parties of that company are responsible <br />for all requirements of the permit.
