STATE OF COLORADO
DIVISION OF MINERALS AND GEOLOGY
Department of Natural Resources
1373 Sherman St, Room 275
Denver, Coorado 80203
Phone: ( 03) 866- 7
FAXIl~1~~C~~t~CC
MEMORANDUM
to: File C-81-019 Colowyo Coal Mine,
2003 "V,//
from: Byron G. Walker
subject: Review for Compliance
date: May 13, 2004
Rule 4.09.1(11) Inspection
Greg E. Walther
Executive Direcor
Ronald W. Canany
Division Director
Natural Resource Trustee
Rule 4.09.1(1 1)(a) The fall shall be inspected for stability by a registered engineer or other
qualified professional specialist experienced in construction of earth and rocl~ll embankments
under the direction of a qualifed professional engineer at least quarterly` throughout the
construction and during the following critical construction periods2: (1)removal of all organic
material and topsoil, (2)placement of underdrainage systems, (3) installation of surface drainage
systems, (d) placement and compaction of fill materials, and (5) revegetation.
The permittee is in compliance with this rule. I This is a quarterly report. A registered engineer
accomplished both the inspection and certification. 2 Installation of surface drainage systems was
a critical construction period encountered during the time period of the report.
Rule 4.09.1(11)(6) The qualified registered engineer shall provide to the Division a certified
report within 2 weeks after each inspection[ that the fill has been constructed as specified in the
design approved by the Division. 2The report shall include a description of any appearances of
instability, structural weakness, and other hazardous conditions observed during the inspection.
A copy of the report shall be retained at the mine site.
The certification indicates that the fill was inspected during the quarter by a qualified specialist,
who was a Colowyo employee, during the quarter, and by a PE on January 19, 2004. The report
was to be provided to the Division within two weeks after the inspection, PAP, Exhibit 19,
Section I, page Ia-4 (February 2, 2004). The report was dated January 20, 2004 and submitted
under a letter of January 20, 2004. It was received at the Division on January 23, 2004.2 Thus the
report was timely. This late review identified that this report, as did the subsequent report, did
not address the appearance of instability, structural weakness, or other hazazdous conditions. The
following report, as amended, included this information. The operator is asked to supplement this
report as well. There were no problems with the fill.
files: C-81-019 Wes[ Pit Fill Reports
C:\WPDOCS\Colowyo\wp fill insp rpt 4q3 tvw.doc
COLORADO
DIVISION OF
MIN &RALS
GEOLOGY
REC LA MATION•M WING
SAFETY•SCIENCE
West Pit Fill Inspection Report, 4th Quarte4~+l ovens
Governor
Office of Office of Colorado
Mined Land Reclamation Active and Inactive Mines Geological Survey
