BOWIE RESOURCES, LLC <br />Bowie No. 2 Mine <br />Coal Mine Waste Bank Certification <br />In accordance with DMG Rule 4.10.2(2), this report is prepared to certify the coal mine <br />waste bank founding and the surface and subsurface drainage systems were <br />constructed as designed and in accordance with the approved plan. <br />The design of the coal mine waste bank is presented in Volume IX of the permit <br />document. Preparation of the coal mine waste bank involved; 1) removal of all organic <br />material and topsoil; 2) placement of the large rock underdrain; and 3) installation of a <br />surface drainage system. <br />The preparation of the coal mine waste bank began in late April and was completed in <br />early July, 2004. I (J. E. Stover, P.E.) inspected the construction numerous times and <br />have a wide variety of experience in the design and construction of earth fill <br />embankments. There were no steep slopes, seepage or other visible factors which <br />would indicate a potential problem with the coal mine waste bank. <br />The construction of the coal mine waste bank is a phased project. A portion of the <br />founding was cleared of all organic material and topsoil. Approximately 400 feet of the <br />large rock underdrain was installed. Interim east and west upper diversion ditches were <br />constructed. It is not practicable or necessary during this phase of the project to <br />construct the east or west collection ditches D-F22 and D-F6. They will be constructed <br />as the pile expands to the east and west. It was also not practicable at this time to <br />construct the upper east and west diversion ditches at there ultimate design elevation. <br />Interim east and west upper diversion ditches were constructed in accordance with the <br />design appended to this certification. <br />The large rock underdrain system and protective filter were installed in accordance with <br />the approved plan. The enclosed color photographs were taken during and after <br />construction, but before the underdrains were covered with excess spoil. <br />To the best of my knowledge and belief, <br />waste bank founding and drainage syste <br />approved plan and meets the requireme <br />Minerals and Geology. <br />with the exceptions noted above, the coal mine <br />m was constructed in accordance with the <br />nts of the Regulations of the Division of <br />
