<br />Both the topsoil and subsoil piles for sub-areas 2-3 and 4 have been seeded and are stable. All of <br />these seeded areas plus the area disturbed during the reclamation of sub-area 1 show vegetative <br />gowth. The topsoil and sub-soil piles along with the pond and other disturbed areas associated with <br />pit Sa that were seeded last fall are showing signs of growth. All organic material and topsoil was <br />removed prior to the storage of refuse in all areas. Sub-area 1 has been reclaimed and is no longer <br />in use. <br />To the best of my knowledge, based on my professional expertise, the permanent refuse structures <br />at the Deserado mine are being constructed in conformance with the prudent state-of--the-art <br />construction practices as they relate to coal processing waste bank construction. Further, the <br />strucnues are being constructed in compliance with the approved design, as specified within Section <br />III-20 of the approved permit documents and depicted on Maps 76,77,82 and 83. <br />I certify, based on my field observations and those observations of my qualified designates and <br />professional investigations, as detailed above, that the permanent refuse disposal structures at <br />Western Fuels-Utah Inc., Deserado Mine, located in Rio Blanco County, Colorado, are being <br />constructed in compliance with the design approve as a portion of Permit No. C-018-81, issued by <br />the Colorado Mined Land Reclamation Division. <br />R~~esp~~ectfu~~lly/~~''~ <br />G'I/G~C~' <br />William C.
