Rule 4.09.1(1 l)(a) The fill shall be inspected for stnbilin~ by a registered engineer or o!her

The permittee is incompliance with this rule. t Thts s a quarterly report. A registered euglueer
accomplished both the inspection and certification. `None of the critical cons[n.lction periods
were encountered during the lime period of the report.
Rule 4.09. I (I I)(b) The qualified registered engineer shall provide to the Division a certified
report within 2 weeks rafter each inspectibnl that the fill has been constructed as specified in the
design approved by the Division. '"Tlte report shall inchrde u description of any appearances of
instnbiliq~, structural weakness, and other hazardous conditians observed during the hrspectior:.
A copy of the report shall be retrained at the mine site.
The action is in compliance with this rule. The inspection was accomplished on June 27, 2001.
The report was prepared on June 28, 2001. The inspection report was submitted to [he Division
under a letter of June 28, 20011, and received at the Division of June 29, 2001. '' The report
included observations on instability, structural weakness and other (lack of) hazardous.
