All sedimentation ponds shall be examined by a qualified registered <br />professional engineer or other qualified individuals under their direction. The professional engineer <br />or individual shall be experienced in the construction of sedimentation ponds. Ponds shall be <br />inspected for structural weakness, erosion, and other hazardous conditions. The report shall also <br />include the level of the sediment in the pond and any other required maintenance of the structure. <br />These inspections shall be made regularly during construction, upon completion of construction and, <br />at a minimum, on a quarterly basis thereafter. The report shall be retained at or near the mine site <br />and a copy of the report promptly submitted to the Division on a quarterly or annual basis, as <br />required by the Division, by a registered professional engineer. <br />The report is in compliance with this rule. Sediment pond inspection reports (reports) are <br />maintained at the mine site (see Division inspection reports). The reports are reviewed in this <br />findings as such reports are submitted to the Division annually (Permit page 4.05-7) in the <br />Annual Hydrology Report (AHR). No sedimentation pond was constructed or was construction <br />completed on any pond during the reporting period. Thus the requirement for quarterly <br />inspections is the only continuing requirement.
