Control Program (Continued) <br />A control program may include, but shall not bey limit~:d to: additional <br />pretreatment requirements imposed on specific i.ndirec': permittees by <br />POTi]'s, modification of internal source control programs by industries, <br />modifications of treatment plants, and/or best management practices for <br />spills, leaks, etc. <br />8. Toxicity Incident Closure <br />If WET is controlled through implementation of numeric limits for <br />specific toxicants, through a control program eliminating toxicants <br />from the waste stream, or through the implementation of treatment <br />processes, or if WET disappears and Division required accelerated <br />testing demonstrate the continued absence of toxicity, the toxicity <br />incident shall be considered closed. <br />If the permittee completes all required phases of the toxicity incident <br />response specified in compliance schedules, and is un¢ible either to <br />identify the causative toxicants and their sources or to identify <br />feas:tble treatment options, the permittee may petition the Division for • <br />reli~af from further investigation aad testing, consistent with the <br />permCt regulations. <br />9. Toxicity Reopener <br />Zf, during ffie first three years after the issuance of this permit, <br />toxicity has occurred in the discharge, or it is estat~lished chat there <br />is a reasonable potential for toxicity in the discharge, this permit <br />shall be reopened and modified to impose WET limitations in a manner <br />consistent with any applicable Federal Regulations in effect,at that <br />time,. Limitations imposed in accordance with such Federal Regulations, <br />if applicable, shall be in effect no later than three years after the <br />date;, WET testing conditions were first incorporated into this issued <br />permjCt.
