Preliminary Tonicity Investigation (Continued) <br />If the preliminary toxicity investigation identifies :i probable toxicant <br />and/or a probable source of toxicity, the permi.ttee shall submit, as <br />part of its final report results, written notificatio~i to that effect <br />to the Division. Within 30 days of completing the preliminary toxicity <br />investigation, the permittee shall submit for the Div:~sion's approval a <br />control program to control effluent toxicity, a.nd shall proceed to <br />implement such plan within 7 days following approval ley the Division. <br />If no probable explanation for tonicity is identified in the 15-day <br />preliminary toxicity investigation, a Phase I T'oxicit~~ Reduction <br />Evaluation (TRE) is required. The permittee shall notify the Division, <br />as part of its final report, of its intent to proceed with the Phase I <br />TEE. <br />If tonicity disappears during the preliminary toxicit~~ investigation, <br />the permit tee shall submit written notification. to that effect to the <br />Division. The Division may require the permittee to conduct accelerated <br />testing to demonstrate the continued absence of toxicity. If no acute <br />to~city is found to exist, the toxicity incident is closed. <br />5. Phase I THE <br />The Phase I THE performed by the permittee shall be in general <br />accordance with Methods for Toxicity Reduction Evaluations, Phase I, <br />Toxicity Characterization Procedures IJraft - June 24, 1988) published <br />by E:P9, or in accordance with procedures approved by t:he Division. If <br />only one species demonstrated toxicity during accelerated testing, then <br />that species alone may be used in the Phase I TRE. Ttie permittee has <br />45 d:sys from the submission of the final report on the preliminary <br />tonicity investigation to complete the Phase I THE and submit a report <br />to Uie Division on the results of the study. <br />If the Phase I THE identifies a probable toxicant and/or a probable <br />source of toxicity, the permittee shall submit writtea notification to <br />that effect to the Division as part of the report. Within 30 days of <br />completing the Phase I TRE, the permittee shall submit for the <br />Division's approval a control program to control WET, and shall proceed <br />to implement such plan within 7 days following approval by the Division. <br />If tae Phase I THE fails to identify a probable toxicant and/or a <br />probable source of toxicity, the permittee shall notify the Divisio^ of <br />its findings. The Division will determine whether a Phase II THE is <br />applicable. <br />If toxicity disappears during the Phase I TRE, the permittee shall <br />submCt written ^otification to [hat effect to the Division. The <br />Division may require the permittee to conduct accelerated testing to <br />demonstrate [he continued absence of toxicity.
