Additional Conditions - Effective at All Times for All Outfalls <br />There shall be no discharge of floating solids or visible foam in other <br />than trace amounts. The discharge shall not contain any sanitary <br />wastewaters from toilets or related facilities, or other pollutants not <br />associated with active mining operations. The Division shall be <br />notified if there is any land application of wastewater, other than for <br />dust control. <br />8. Burden of Proof Requirements (A11 Outfalls) <br />The permittee shall have the burden of proof when requesting relief <br />from total suspended solids (TSS), total iron and/or settleable solids <br />limitations. <br />For rainfall, to waive TSS and total iron limitations, it is necessary <br />to prove that discharge occurred within 48 hours after measurable <br />precipitation has stopped. In addition, to waive settleable solids <br />limitations, it is necessary to prove that discharge occurred within 48 <br />hours after precipitation greater than the 10-year, 24-hour event has <br />stopped. <br />For snowmelt, to waive TSS and total iron limitations, it is necessary <br />to prove that discharge occurred within 48 hours after pond inflow has <br />stopped. Ia addition, to waive settleable solids limitations, it is <br />necessary to prove that discharge occurred within 48 hours after pond <br />inflow volume greater than the 10-year, 24-hour event has stopped. <br />The Division shall determine the adequacy of proof. <br />9. Post-Mining Areas <br />The permittee shall notify the Division upon cessation of active mining <br />and completed reclamation of areas contributing to discharge point 001 <br />and/or 006 so that appropriate permit modifications can be made. <br />• <br />
