March 30, 2004 Colorado Division of Minerals and Geology 1313 Sherman Street, Room 215 Denver, CO 80203 Re: Annual Report for Permit No. M-1977-534, Empire Pit To Whom It May Concern: RECEIVE® MAR 31 2004 Dimsioo of AAicerais $ iita~, Attached please find an "Annual Report Progress Map" for the Empire Pit in Clear Creek County, and the signed "Annual Fee and Report Request" form. The annual fee of $688 was submitted to the Division in December of 2003. Mining at this site was completed in 2003. The dam (known as Guanella Dam and Reservoir) was approved for construction by the State Engineer's Office (SEO) on May 20, 2003, and construction was approved and permission fill the reservoir granted by the SEO on March 29, 2004. The slopes around the reservoir have been graded to final reclamation contours, and seeding and mulching will be performed this spring. Mined material is stockpiled within the east side of the permit area (east of the dam), and will continue to be processed on site for approximately 3-5 years, depending on market conditions. Preparation of the attached Progress Map revealed that portions of the material stockpiles may be located outside of the permit boundary in the southeast corner.
