NOV C-97-016 Modification <br />1) Modify "NATURE OF VIOLATION" as follows: <br />Failure to ensure proper surface drainage control and failure <br />to construct or maintain diversion and collection ditches on <br />coal waste disposal areas CRDA #1 and CRDA #2 in accordance <br />with permit requirements and with performance standards <br />pertaining to diversion of upland flow, drainage over the <br />outslope of the fill, and passage of all disturbed flow <br />through a sediment pond or treatment facility. <br />2) Modify "ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED" by <br />adding the following: <br />PERMIT SECTIONS Exhibit 20 and Exhibit 53 <br />3) Modify "PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES" <br />by adding the following: <br />i _ <br />_ CRDA #2 Upper Diversion Segments represented by DM#7, DM#8, <br />~_~ and DM#9 measurement locations identified in the Refuse Area <br />"Special Focus" Inspection Report Addendum.. <br />RSRDA South Diversion Segments represented by DM#15, DM#16, <br />and DM#18 measurement locations identified in the Refuse Area <br />"Special Focus" Inspection Report Addendum. <br />RSRDA Lower Catch Ditch #2 <br />4) Modify "STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION)" <br />by adding the following: <br />(5) Restore CRDA #2 Upper Diversion, RSRDA South Diversi\r~, <br />and RSRDA Lower Catch Ditch #2 to compliance with appr <br />permit by December 1. 1997. <br />(6) Submit P.E. statement certifying that CRDA #2 UppAC <br />Diversion, RSRDA South Diversion, and RSRDA Lower Catch Ditch <br />#2 are in compliance with approved permit by December 8. 1997. <br />,. <br />~.i. _~.~:-_~~.._ ... ..~.. .~.. - .. .... ... <br />
