Dept. of Natural Resource <br />I am in receipt of your letter, a copy of which is attached. <br />I am also sending a copy of this to Mr. Michael Stanton because I spoke <br />with him regarding this letter last Wednesday, December 2, 1981. I <br />understand from Mr. Stanton that on a county-by-county basis you review <br />permits that have been issued to insure that all operators have paid their <br />annual fees. <br />Some background may be helpful in understanding the situation <br />and as your records indicate on November 5, 1919, permit no. 79-197, a <br />special permit was issued permitting Braley Sand & Gravel to mine an <br />acreage not to exceed 9 acres with the further limitation that the annual <br />extraction of mineral and overburden not exceed 70,000 tons. That was by <br />way of an application filed November 1, 1979. A bond of $22,500.00 was <br />posted for this special permit by way of a certificate of deposit in that <br />same amount dated November 1, 1979. <br />Shortly after this special permit was issued and banded appli- <br />cation was made for limited impact permit encompassing this same area and <br />slightly expanding it from 9 acres to 9.75 acres. On November 28, 1979, <br />a little over three weeks after the approval of the special permit, the <br />limited impact permit was issued using the same number 79-197. A certi- <br />ficate of deposit dated November 29, 1979 in the amount of $2,500.00, the <br />amount required fora bond under the limited impact permit again the same <br />number as the special permit 79-197 was drawn. On November 30th, I per- <br />sonally hand-carried the surety agreement and bond for the limited impact <br />permit and delivered the same to Jim Schmeiding at which time he released <br />the previously posted $22,500.00 bond for the special permit. Thus within <br />a period of approximately one month, the Braley operation was first bonded <br />,O,s~~ ~ 3 ~~ i <br />
