Rule 4.09.1(11)(a) The fill shall be inspected for stability by a registered engineer or other
qualified professional specialist experienced in construction of earth and rockfill embankments
under the direction of a qualified professional engineer at least quarterly) throughout the
construction and during the following critical construction periods2: (1)removal of all organic
material and topsoil, (2)placement of underdrainage systems, (3) installation ofsurface drainage
systems, (4) placement and compaction offll materials, and (S) revegetation.
The permittee is in compliance with this rule. 'This is a quarterly report. A registered engineer
accomplished both the inspection and certification. 2 Installation of surface drainage systems was
a critical construction period encountered during the time period of the report.
Rule 4.09.1(1 I)(b) The gualified registered engineer shall provide to the Division a certified
report within 2 weeks after each inspection) that the fill has been constructed as specified in the
design approved by the Division. 2The report shall include a description of any appearances of
instability, structural weakness, and other hazardous conditions observed during the inspection.
A copy of the report shall be retained at the mine site.
The certification indicates that the fill was inspected on September 26, 2003. The report was to
be provided to the Division by October 10, 2003 (within two weeks after the inspection, PAP,
Exhibit 19, Section I, page Ia-4). The report was submitted on a -etter of October 6, 2003 and
received at the Division on October 9, 2003. 2 The report included (indirectly) observations on
instability, structural weakness and other (lack of) hazards. There were no problems with the fill.
