PROOF OF PUBLICATION -NEWSPAPER NOTICE <br />Please provide the Division with proof of re-publication of the newspaper notice. The need for re- <br />publication of the notice has been explained in detail in the Division's July 30 and August 8, 1997 <br />letters to the applicant. <br />EXHIBIT C -PRE-MINING AND MINE PLAN MAPS <br />None of the maps provided with the application clearly show all power and communication lines on <br />the area of affected land and within 200 feet of all boundaries of such area. The proposed affected <br />and adjacent areas contain several Empire Electric Association power lines and U.S. West telephone <br />communication lines. These lines occur along U.S. Highway 160, along the county roads within and <br />adjacent to the proposed affected area, and can also be found leading from the highway and county <br />road corridor power and communication lines to private residences and other facilities situated within <br />and adjacent to the proposed affected area. Please correct the appropriate map(s) within the <br />application to clearly show the location of all such power and communication lines. <br />Appropriate maps within the application need to be revised to clearly show the owner's name, type <br />of structures, and location of all permanent or man-made structures contained on the proposed 368 <br />acre affected area and within two hundred (2001 feet of the affected land. As defined in Rule 1.1 <br />(48), such structures include but are not limited to: buildings, houses, barns, fences, above or below <br />ground utilities, irrigation ditches, maintained or public roads, bridges, railroad tracks, cemeteries, <br />communication antennas, pipelines, water wells, water storage impoundments, discharge and <br />conveyance structures, etc. As a reminder, it is the applicant's responsibility, not the Division's, to <br />accurately identify all such structures and to show their location on an appropriate map within the <br />application, <br />The map entitled "EXHIBIT C ORION PIT M-94-1 15 PRE-MINING MAP & MINING MAP" with a map <br />scale listed at 1 inch = 1,320 feet needs to be redrawn at an acceptable map scale (not larger than <br />1 inch equals 50 feet nor smaller than 1 inch = 660 feet) that is appropriate to clearly show all <br />elements that are required to be delineated by the Act and Rules, including all permanent or man-made <br />structures on and within 200 feet of the proposed affected land. Incidentally, the map scale shown <br />on the title block is inaccurate. The correct scale is approx. finch = 1,260 feet. <br />The map entitled "EXHIBITS B, C, & F MINING & RECLAMATION PLAN ORION PIT M-94-115" <br />is inadequate in the following respects: 1) The map does not identify and outline the full area which <br />corresponds with the application. Only a portion of the proposed 368 acre permit area is shown on <br />the map, and the proposed permit area boundary is not clearly delineated; 21 The map does not show <br />the size and location of each area to be worked during each phase, or the sequence in which each <br />stage or phase of the operation will be carried out. The map only shows the initial mining phases <br />situated within the northwest portion of the proposed affected area; 3) The map does not show all <br />permanent or man-made structures on and within 200 feet of the proposed affected area; 4) The map <br />does not show the location of access & haul roads or material stockpile locations associated with <br />mining operations planned to be conducted on the east side of County Road 38; and 5) The map scale <br />shown on the title block is inaccurate. The correct scale is approx. finch = 164 feet as verified by <br />checking distance measurements delineated on the map. <br />00242 <br />z <br />
