Long <br />D~nsion Dlreaer <br />The Division of Minerals and Geology has completed review of the 1'L Quarter 1999 inspection <br />reports for the Refuse Disposal Area and Development Waste Pile at the New Elk mine. As a <br />result of this review we have the following questions or comments. <br />l . Included with the materials was an Annual Inspection Report for the RDA pond. Is this a <br />copy of the report to meet the requirements of 30 CFR 77.216-3? For which state program rule <br />does this report comply with? <br />2. The reports submitted for the RDA and the DWP are routine ] s` quarter reports, which <br />satisfy the requirements of Rule 4.09.1(11)(a). The report did not specifically address the side <br />drain reconstruction nor did it identify the specific design included in Exhibit 20 of the permit. <br />Please ensure that the next inspection specifically addresses the downdrain reconstruction and <br />certifies the work in accordance with the approved design plans.
