I have reviewed Basin Resources Annual Reclamation Reports for the New Elk Mine for
compliance with Rule 2.04.13. My comments regarding the reports follow.
New Elk:
(1)(a) The address of the permittee is not included on the actual report. It is included on
the cover letter. Inclusion of the cover letter as a part of the report will cover this
portion of the rule. It is preferred that the name and address of the permittee, and
the permit number be included on the actual report.
(b) ].4 acres were disturbed in 1995 with the construction of the refuse disposal area.
The enclosed map, New Elk Mine Annual Reclamation Report East Portal, signed
by Ralph Lopez on 1/24/96, does not show the location of the reported disturbance.
The location and extent of the disturbance need to he included on a map.
(c) No backfilling or grading occurred in 1995.
(d) No topsoil application was conducted in 1995.
(e) 0.5 acres were seeded at the Refuse Disposal Area in 1995. The map does not show
where this seeding occurred.
The seed mix used was supposed [o be included on an accompanying page. That
page was not submitted with the report. Basin Resources needs to define what was
seeded, what methods of seeding were used, what seeding rate was used and when
it was seeded. Timing of seeding is important when determining revegetation
success, i.e. Fall vs. Spring.
(f) Location, acres, and date of planting of all previously revegetated areas. The 1995
Annual Reclamation Report Map does not explain what the "Key" represents. The
legend should be defined on the map not just in the report text.
