Long <br />Denver, CO 80202 olvibion Director <br />RE: Exemption from Desig))ated Mining Operation Status, Sunday Mine, Permit No. M-77-285 and <br />West Sunday Mine, Pero~it No. M-81-021 <br />Dear Ms. Rebmann <br />Afrer review of your latest report regarding the test results of the average uranium content of the waste <br />dumps at the referenced mine sites it is the Division's decision that you have satisfactorily demonstrated to <br />the office that the above referenc(~ operations are not Designated Mining Operations as defined in Rule <br />1.1(14). However, pursuant to Rule 7.2.6(2), nothing in the exemption shall exempt an operator where site <br />conditions or circumstances change. <br />Therefore, if mining activities an; re-initiated at these sites, the Division may submit a new notice of <br />determination which may require aldditional testing of the waste dumps. <br />If you have any questions, please live me a call. <br />Sincerely, <br />~, ` <br />~~ ~ ` <br />H.
