Dan, I was assigned the task to complete reviews of the subject Coal Waste Pile Inspection
Reports for 1999. This is my review.
The l~' and 2nd Quarter reports have been reviewed by Tom Kaldenbach (Division letter of
November 29, 1999) and were found to be in compliance with Rules 4.09.1(1 l)(a), 4.09.1(1 I)(b),
4.09.1(1 l)(c). 4.10.2(1),4.10.2(2)(b), and 4.10.2(3). Janet Binns had reviewed the Fourth Quarter
1999 report and found it incompliance with the exception of the date of submittal (it was late).
The third quarter report was submitted on October 18, 1999 and was received at the Division on
October 27, 1999. [found no review in the file of this report. This is a review of the 3rd quarter
report.
Rule 4.10.2 Site /nspection
Rule 4.10.2(1) AN coal mine waste banks shall be inspected. on belrnlf of the person conducting
surface cord mining operations by a qualified registered en,i;ineer, or other qualified professional
specialist under the direction of the professional engineer, experienced irr constrrction of similar
earth and waste structures, approved by the Division.
The inspection report consists of a Northwest Colorado Consultants, Inc. letter of October l8, 1999,
submitted to Twentymile Coal Company. A statement is made therein that "our fitm visited the
project site on September 17, 1999 to observe/inspect the constntction operations." I found no
statement that a qualified registered engineer or someone had conducted the inspection under the
direction of the professional engineer. However, such might be implied as a Colorado registered
professional engineer (Brian D. L,en) signed [he letter report.
