Energy <br />Coloa~yo Coal Conr~any L.P. ~ ~;~~: <br />Memorandum <br />FOR: File July 10, 2002 <br />West Pit Fill Construction Report <br />During the quarter beginning April 1, 2002 and ending June 30, 2002, I <br />inspected the area in which the West Pit Excess Spoil Fill is being constructed. <br />The purpose of these inspections was to inspect the fill surface for vegetative <br />efforts; inspect the fill for areas of water seepage or surface drainage and to <br />satisfy the requirements of CMDG.. Rule 4.09.1 (ila). <br />During the quarter no progress was made on the West Pit Fill. No <br />overburden was hauled to backfill in the West Pit due to spoil room constraints. <br />No topsoil was dumped on the West Pit backfill bench below the 7350 elevation on <br />the fill. No sloping to final grade occured either. <br />Attached to this report are my certification that all construction <br />requirements have been met thus far in constructing the West Pit Excess Fill. <br />Stephen R.
