Therefore, there does not appear to be a conflict with the
current Zoning Resolution which requires Use by Special Review for open
mining operations.
Should this permit application be approved by the State Mined Land
Reclamation Board, the County requests that all technical revisions,
annual reports, or changes in the permit be referred to us for the
purpose of determining compliance with County zoning requirements.
Further, the permit should be linked to an accurate description of 9.5
acres which can be identified in the field. The operation should con-
tinue to remove no more than the approximate amount of material ex-
tracted in the past and should not include a significant expansion in
the number of days of operation per year. Records of the operation
should be kept and made available to the County for review, if requested
at some time in the future.
In regard to the reclamation plan, the following matters were discussed
with the Planning Commission and are submitted for your consideration.
1. The State Staff should review available data to insure that adequate
overburden from the Martin Marietta Lyons Plant site is available
to complete the reclamation.
