.. .-._
Mr. Robert Liddle -2- May 15, 1984
flow analysis to date does not balance well with the quantities of
water being pumped from the mines, it is our belief that very little
definitive information will come from the continued mine in-flow
studies. Despite limited information, we agree that it makes sense
to continue the studies. It is now apparent that the meaningful
data in regard to validity of potential claims for downstream water
rights will come from making calculations as quantitatively as
possible for the difference in flow in the creeks upstream and down-
stream in both North and Middle Thompson Creeks. Some assumptions
will obviously have to be made to account for evaporation and water
consumption by the vegetation in that area. Despite this, it is
believed that the sources of water in the mines at Snowmass will be
known well enough to design a final augmentation plan.
With the current snowpack at 90% above normal, we believe that
there is no risk of calls for water for this year. Assuming that we
learn from our recent design mistakes on weir installation, and have
the four weirs successfully operating for the 1985 season, we request
that we be allowed to delay filing a final augmentation plan with the
State Water Engineer until summer 1985 water flow data can be obtained.
Snowmass Coal Company is prepared at this time to take responsi-
bility for pumping into North Thompson Creek below Mine lll, a minimum
of 17,000 gallons per day during any time that valid calls are in
effect downstream. Snowmass would want to reserve the right to
switch our interim augmentation efforts to any other appropriate means,
versus pumping the mine, to provide the same minimum 17,000 gallons
per day downstream.
Very truly yours,
SNOWMASS COAL COMPANY, a
Colorado General Partnership
BY: ROARING FORK COAL CORP.,
Its General Partner
BY: k).~V__ ~ I~
William S.
