COyy ps`~~G-ti _ <br />Subject: Expansion of the Coal Mine Waste Pile ~- ~ q S Z -" / ' <br />Dear Mr. Nettleton, with reference to your telephone call of 09:56 this morning, and our subsequent telephone <br />conversation this afternoon, I found no provision in the rules that would (outright) prevent the proposed action of limited <br />expansion of the waste pile to the east as was described. In the current permit, the setback from the drainage way was to <br />provide room for the road. This answer is limited in scope, and is not approval for such work, nor an indication that any <br />specific proposal would be approved. There are number of rules that apply to such a proposal, and the Division of Minerals <br />and Geology (Division) would require a specific revision application to determine a proposed decision. A preliminary review <br />of the information in the Permit Application Package (PAP) found that a number of items would need to be considered. <br />They include, but are not limited to, additional geotechnical information to the east, redesign and stability analysis of the <br />modified pile and relocated haul road, designs for waste pile toe drain modifications, and revised surface drainage. To be <br />specific, the Division would require the specific proposal idicated above for a detailed review for compliance with all of the <br />applicable rules. There is a reference to an ear)ier plan for a larger waste pile in the PAP. This plan was not found here at <br />the Division. If it could be recovered, some of your questions might be answered therein. If you should decide to prepare <br />some preliminary concept plans, we might have an informal conference to provide more detailed guidance.
