period from March I through July 31 in either of the last two years of the <br />evaluation period is 40°1° or more below the annual average for that <br />period, as set forth in Table 14.1, then Idarado may elect that such year's <br />sampling data shall not be used to determine compliance for any tailings <br />pile located on the side of the Remedial Site in which such reduced <br />precipitation occurs. Idarado will inform the State in writing of such an <br />election and supply verification from the appropriate weather station of <br />the precipitation levels for that year. In the event of such an election, the <br />evaluation period for the applicable tailings piles located on the affected <br />side of the site will he extended until compliance determinations have <br />been made in two consecutive years, or two non-consecutive years <br />separated only by years for which Idarado has elected not to use sampling <br />data to determine compliance because of reduced precipitation. <br />10. Paragraph 16.4 is modified to read as follows: <br />16.4. Localized or Test Plot Failure. For any pile segment that does not <br />meet the revegetation Performance Objectives set forth in ¶ 16.1 of this <br />RAP, Idarado will conduct such reconnaissance and testing as may be <br />necessary to determine whether there is "localized failure" in the segment, <br />or whether failure of a test plot has caused a failure in a segment. <br />"Localized failure" is defined as a condition in which total cover, live <br />cover, and/or diversity of plant species fall 30% or more below the <br />Performance Objectives in ¶ 16.1 in an area or areas which, when added <br />together, do not exceed ] 0% of the total acreage of that particular pile <br />segment. Where a localized failure is determined to exist, or where the <br />results of sampling in test plot areas fall below the Performance <br />Objectives in ¶ 16.1, Idarado will recalculate the total cover, live cover. <br />and species diversity for that segment, excluding the results from the area <br />or areas of localized failure or any test plots that fal[ below the <br />Performance Objectives. If, after excluding the areas of localized failure <br />or any failed test plots, the recalculated results of the segment sampling <br />meet the Performance Objectives in ¶ 16.1 of this RAP, Idarado will be <br />required to conduct additional management activities, as provided in <br />¶ 14.1 .4 of this RAP, only in the areas of localized failure or the <br />appropriate test plot(s). If the recalculated results do not meet the <br />Performance Objectives, Idarado will conduct additional management <br />activities as provided in ¶ 14.1.4 of this RAP for the entire pile segment. <br />1 I.
