Leulconen: <br />It has come to our attention that you are conducting a sandstone <br />quarry mining operation located at approximately 2 miles north of <br />Lyons, Colarado. <br />lde can find nothing in our records to indicate that you have applied for <br />or obtained a mining and reclamation permit from the Colorado Mined Land <br />P,eclamation Eoard for this mining operation. All mining operations in <br />the state of colorado must be permitted by the board under authority of <br />the Colorado Mined land Reclamation Act, Article 32 of Title 34, C.R.S. ' <br />1973, an amended (1976 Sesa. Lams - II.B. 1065). ~ <br />Several different situations nay apply to your operations: (1) If your <br />mining operation is nocr pezmanently closed down but c~aa in operation <br />after July, 1973, there are reclamation requirements which you should .; <br />discuss crith this office, it you crere mining sand and gravel, open coal, <br />limestone for construction purposes or quarry aggregate. (2) If your <br />operation is intermittent, seasonal, or continuous during the year and, <br />under any of these conditions, can be considered presently active, or <br />active after June 30, 1476, it must be permitted under the Colorado Mined <br />Land Reclamation Act. If your operation is seasonal, this winter would <br />be a convenient brae to apply €or a permit. <br />If you have a mining and reclamation permit or have applied for one, <br />please send us your permit number and the associated correct name of <br />your company. If you have not yet applied, please consult the enclosed <br />Rules and Regulations and submit either a limited impact or regular <br />permit application (I10 and 112 forms enclosed). <br />Please be advised that the consequences of operating a mine without a <br />permit can be substantial and severe. Our desire is not to harass <br />businesses, or cause enconomic hardship, but to effectuate compliance <br />with the state reclamation law by all mining operators. Such a law can- <br />not be equitable, nor can we achieve reclamation at all mines, unless all <br />operators comply.
