Ehmett, Deputy Director <br />Albuquerque Field Office <br />Office of Surface Mining Reclamation and Enforcement <br />625 Silver Avenue, SW <br />Suite 310 <br />Albuquerque, New Mexico 87102 <br />Re: Permitting Evaluation, Oversight Tour <br />Dear Mr. Ehmett: <br />Now that the joint OSMRE, State oversight tour is completed, the Division <br />would like to resolve any outstanding issues prior to completion of the <br />oversight report. It appears that two issues need resolution, First, <br />possible stability concerns with the Roadside/Cameo Rule No. 1. The second <br />issue is more generic in nature, dealing with deviations from the final <br />reclamation configuration of piles and drainage structures during the <br />operational phase of development.. Given this, we would propose the following <br />resolution. <br />Conditions at the Roadside/Cameo pile have changed since the original designs <br />were reviewed. Specifically, hydrologic conditions at the pile have deviated <br />from the assumptions made in completing the original stability analysis. We <br />will require the operator to demonstrate that the original design for the <br />waste pile is still in compliance with our regulations. In addition, we will <br />require that the operator refrain from depositing additional waste on the pile <br />until the above demonstration is made to the Division's satisfaction. We will <br />also require that the existing drainage system be reviewed for compliance as <br />part of the above demonstration. If the required demonstration reveals any <br />stability or drainage problems, the operator will be required to modify his <br />permit as necessary. In addition, we will document that the operational <br />configuration of the pile may vary from the permanent reclaimed configuration <br />and will be in compliance with Rule 4.10. Regrading of the two bottom benches <br />will also be required as a part of the final reclamation configuration. <br />Resolution of the second problem is more general in nature. While we are <br />comfortable with the final design configuration of these waste piles we <br />realize that during the construction and operational phase these final <br />configurations may not be appropriate. The Division agrees that documentation <br />concerning the configuration of waste piles and the required diversions and <br />drainage designs during the operational phase has not always been discussed in <br />detail. <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
