The report indicated that the <br />site has been inactive for at least six months. Please refer to the finerals Rules <br />and Regulations Sections 1.6.2 and 1.6.2(2)(a) which state that if an operation <br />ceases production fora period of 180 days or more, the operator must file a Notice <br />of Temporary Cessation with the Board, This notice must stata the date of <br />cessation, the reasons for cessation, a plan for the reswnption of mining, a <br />description of those activities the operator will take to ensure compliance with <br />the permit reclamation requirements and a description of site maintenance <br />activities to ensure compliance with the performance standards (Rule 6). The <br />Notice of Temporary Cessation should be sent to the Division separate from other <br />correspondence. <br />As an alternative to temporary cessation, you may amend your permit to indicate <br />that the operation will be intermittently active throughout its life. The <br />amendment application must include a description of those activities the operator <br />will undertake to ensure compliance with the permit reclamation requirements, and a <br />description of the site maintenance activities :vhich will ensure compliance with <br />the performance standards (Rule 6). Rule 1.6,2(2)(d) addresses this amendment. <br />Since the annual report indicated that operations have temporarily ceased, you <br />should submit either a request for temporary cessation or a per~it amendment within <br />the next 45 nays. If the request indicates that the site is sufficiently <br />stabilized, we will approve the request for cessation rdithin sixty days, If the <br />request indicates that there may be some problems with the sites, we will either <br />request more information from you, or schedule the site for an inspection, If you <br />submit an amendment to the permit, we will process it within 30 to 90 days for 110 <br />and 112 operations, respectively. <br />If you have questions, please do not hesita to to call, <br />Sincerely, <br />. <br />Barbara D.
