Box "4-,fIb <br /> Naturita, Colorado 81422 <br /> RE: Jack Knife Mine - File No. <br /> Last Chance Mine - File No. 4 <br /> Paradox View Mine - File No. M-77-548 <br /> Dear Mr. Williams; <br /> Our Senior Reclamation Specialist, Mark Loye, has reviewed the files on the <br /> three operations captioned above and finds that all three are still actively <br /> permitted. Furthermore, each operation is still properly bonded (as must be <br /> the case if the Board has not released your reclamation responsibility) . <br /> Therefore, you must still submit a $50.00 annual fee and an annual report for <br /> each of the three operations. The fees and reports have not been submitted <br /> and are all overdue since the anniversary date by which they were due is <br /> June 16, 1985 for all three operations. Therefore, we have found that there <br /> is reason to believe a violation exists of each of permit nos. M-77-467, <br /> M-77-468 and M-77-548 and of the Mined Land Reclamation Act and have scheduled <br /> these matters before the Mined Land Reclamation Board. <br /> Three Formal Public Hearings will be held during the October 23-24, 1985 Board <br /> Meeting for consideration of possible violations on each operation. The <br /> hearings will be held in Room 110 of 1313 Sherman Street, Denver, Colorado <br /> beginning at 9:00 a.m. or as soon thereafter as the matters can be considered, <br /> and you will have the opportunity to be represented and heard. It will be <br /> reiterated that there is reason to believe that you are in violation of these <br /> permits and the Act, specifically the following provision: <br /> Failure to provide annual fees and notices of intent to continue mining <br /> (annual reports) for 1985 as required by 34-32-110(4) , C.R.S. <br /> If the Board finds violations at these hearings, it may issue a cease and <br /> desist order on each operation, assess a civil penalty for each operation in <br /> the range of $50.00 to $200.00 for each day of violation or order the permits <br /> suspended, modified or revoked.
