Lamm <br />Governor <br />MEMORANDUM 1.~.-"~' <br />' 19 J e 1986 - - <br />T0: Dan Mathews <br />FROM: Jim Pend]eton i <br />RE: Foidel Creek M - R ponse to Geotechnical Adequacy Review Comments <br />Permit No: C-85-056) <br />I have completed a review of the March 28 and May 22, 1986 adequacy review <br />responses made by Twentymile Coal Company (Cyprus Western). I specifically <br />reviewed the responses to the geotechnical comments contained in IRy December <br />31, 1985 memorandum to you. <br />The applicant's supplemental submittals have resolved my concerns regarding <br />"B ackfilling and Grading" (Rules 2.05.4(2)(c) 8 4.14), and "Sealing Portals" <br />(Rules 2.05.4(2)(8) 8 4.07). However, several of nlY concerns regarding <br />"Subsidence Control" (Rules 2.05,6(6) and 4.20) will require additional <br />amendment, as outlined here after. <br />Subsidence Control: Rules 2.05.6(6) 8 4.20 <br />(1) The Division requested the applicant provide detailed information to <br />discern whether structures inventoried by the company would require <br />addtional constraints to protect the health and safety of the public. <br />In response to earlier comment, the applicant has indicated only that <br />"Access to the structures listed in the inventory is controlled by <br />TCC. No additional constraints for the described structures are <br />proposed at this time to protect the health and safety of the public. <br />This response is inadequate to satisfy my earlier concern. The <br />operator will have to describe the methods of "controlling access" to <br />the structures. The Division is responsible for assuring the <br />protection of the public, including hunters, ranchers, tourists, etc. <br />The operator must provide sufficient detail to allow the Division to <br />find that the health and safety of the public is assured. I recommend <br />that signage be installed at appropriate locations on the controled <br />structures to inform people of the potential hazards. <br />(2) In our earlier adequacy comments we expressed concern for the <br />maintenance of the irrigation facilities within the potentially <br />subsided area. The applicant has responded; "Prior to mining under the <br />areas where the (irrigation) structures are located, a survey will be <br />conducted to determine which structures are active. Appropriate <br />monitoring will be conducted at that time.
