ENCLOSURE 2 2004 Annual Reclamation Report Rule 2.04.13(1)la)-If) general reporting requirements The Division's new and improved Annual Reclamation Reporting form was properly included in the 2004 report. However, there are inconsistencies with the cumulative disturbance acreages for various disturbance categories. Please check the assumptions used in deriving the acreage figures, and amend the form as warranted. The sum of "acreage in active mining areas", "cumulative total of acres backfilled and graded", and "acreage in long-term mining or reclamation facilities", must total to the "Cumulative Total" acres disturbed. "Entire Life of Mine" number of acres disturbed should be exactly equal to "Cumulative Total" acres disturbed, since there has been no Phase III bond release at Seneca II-W. The cumulative acres disturbed should also be consistent with the total disturbance acreage (Mine Area plus Tie Across Haul Road) reported on page 2 of the report. The report form will need to be amended, and the acreages reported on page 2 for Mine Area and Tie Across Haui Road will also need to be amended if those figures are incorrect. 2. The calendar year "acres disturbed" category on the report form table indicates 30.8 acres. However, the "2004 Reclamation Map" shows three separate areas of topsoil removal, totalling 31 acres. For consistency, these figures should be identical. Also, the 1.0 acre topsoil removal area associated with the "A" Pit slope reduction slide remediation was not shaded blue, as indicated in the map legend and as was done for the other two topsoil removal areas. Please amend the map and table as appropriate. The reporting form indicates that 26.3 acres were backfilled and graded during the year. However, the 2004 Reclamation Map appears to indicate that 22.2 acres were graded, topsoiled and seeded, and an additional 20.1 acres graded but not topsoiled or seeded (a total of 42.3 acres backfilled and graded). Please address this apparent discrepancy, and amend the map andlor reporting form as appropriate, to ensure accuracy and consistency, 4. The reporting form indicates that 209.8 acres were topsoiled during the year. However, the 2004 Reclamation Map appears to indicate that 280.1 acres were topsoiled and seeded, and another 38.9 acres topsoiled but not seeded (a total of 319 acres topsoiled). Please address this apparent discrepancy, and amend the map and/or reporting form as appropriate, to ensure accuracy and consistency. The reporting form indicates that a total of 234.6 acres were seeded during the year, whereas the 2004 Reclamation Map lists 222.5 acres as seeded in 2004. A portion of all of the "missing" acreage may be in the green shaded seeded and "tree plot" area along the final highwall graded slope at the north end of the "D" Pit area. No seeded acreage was listed for this parcel on the map. A portion of the parcel was originally seeded in 2003, but was seeded again in 2004. Please address the apparent acreage discrepancy, and amend the map and/or reporting form as appropriate, to ensure accuracy and consistency. Note that acres initially seeded in a given year and reported in the ARR form for that year, then seeded again in one or more subsequent years, should not be included under "calendar year acres seeded"
