(Northwest Colorado Consultants, Inc.) has prepared this letter outlining our <br />observations made during the second quarter of 2003 at the Refuse Pile, which is located at the Foidel <br />Creek Mine in Routt County, Colorado. During this quarter, we visited the project site on June 27, 2003 to <br />provide our quarterly observations. <br />At the time of our visit we met with Mr. Rick Mills and observed that the majority of the refuse materials <br />(waste coal) that were produced during this quarter appeared to have been stockpiled in Areas 1 and 2. It <br />also appeared that some of the stockpiled materials had been knocked down and leveled off; however, our <br />firm was not requested to take any compaction tests during this quarter. It should also be noted that our <br />firm has not been requested to test the compaction of the waste coal fill materials since October 18, 2002. <br />At the time of our visit, we did not observe any signs of adverse drainage conditions on the pile. However, <br />we did notice a slight amount of groundwater seepage coming from the east face of the lower bench of <br />Area 1 at the toe and several hundred feet north of [he temporary haul road going into the pile. No <br />evidence of additional seepage or slope movement was observed above the seep. Mr. Mills advised us that <br />[he seepage was probably coming from one of the shallow drains that were constructed in this area prior to <br />the placement of the soil cover materials over the waste coal. <br />We were advised that [he mine had produced approximately 57,600 cubic yards of waste coal during this <br />quarter and that approximately 10 to 15 percent of the total amount consisted of fines that were not placed <br />in [he pile.
