The site was inspected on September 27, 2005. The report was thus due at the Division on <br />October 10, 2005. It was received at the Division of Minerals and Geology (Division) on <br />September 30, 2005, under a Northwest Colorado Consultants, Inc. letter of September 9, 2005. <br />The report was submitted timely. <br />Rule 4.09.1(11)(c) See the rules for the text of this rule. This rule applies to photographs of <br />underdrains. No underdrains were constructed during the report period. <br />Rule 4.10.1(1) All coal mine waste shall be transported and placed in new and existing disposal <br />areas approved by the Division for this purpose. These areas shall be within a permit area. The <br />disposal area shall be designed, constructed, inspected and maintained: <br />This is an inspection report of an existing, under-construction, pile. <br />Rule 4.10.1(1)(b) To prevent combustion. <br />Materials were being stockpiled in preparation of spreading and compaction. <br />Rule 4.10.2(1) All coal mine waste banks shall be inspected, on behalf of the person conducting <br />surface coal mining operations by a qualified registered engineer, or other qualified <br />professional specialist under the direction of the professional engineer, experienced in <br />construction of similar earth and waste structures, approved by the Division. <br />See Rule 4.09.1(11)(a) above. <br />Rule 4.10.2(2)(a) Inspection shall occur at least quarterly, beginning within 7 days after the <br />preparation of the disposal area begins. The Division may require more frequent inspection <br />based upon an evaluation of the potential danger to the health or safety of the public and the <br />potential harm to land, air and water resources. Inspections may terminate when the coal mine <br />waste bank has been graded, covered in accordance with 4.10.4(4), topsoil has been distributed <br />on the bank in accordance with 4.06.4, and revegetated, or at such a later time as the Division <br />may require. <br />This was a report of a quarterly inspection. <br />Rule 4.10.2(2)(b) Inspections shall include such observations and tests as may be necessary to <br />evaluate the potential hazard to human life and property, to ensure that all organic material and <br />topsoil have been removed and that proper construction and maintenance are occurring in <br />accordance with the plan submitted under 2.05.3(8) and approved by the Division. <br />The report is in compliance with this rule. Compaction tests were conducted. Piezometer <br />readings were taken. <br />
