<. <br />New Elk Mine <br />(1UARTERLY COAL WASTE BANK INSPECTION REPORT <br />CDMR Rules4.09.1(11) and 4.10.2(2) <br />Mine: NEW ELK <br />Waste Bank MSHA ID. No.: Development Waste Disposal Area <br />Inspection Period: Third Quarter 2006 <br />Inspection Date: 9/30/2006 <br />General Description or Reference to Site Plan: <br />The Development Waste Disposal Area is located south of State Highway 12 and west of <br />the main facility Access Road. It is adjacent to and north of the Middle Fork of the <br />Purgatoire River. The area has been used for disposal of waste rock from the underground <br />mine. Since mine Gosure in 1989, the area has been used for disposal of sediment removed <br />from ponds and ditches kxxted within the mine permit area. <br />Activity During Inspection: <br />No activity occurred during the inspection; All equipment has been transported to the Lorencito <br />Mine to complete reclamation there. Prior to departure, the surface of the disposal area had <br />been regraded several times to improve drainage and achieve required compaction. Surface <br />was predominentty dry and unaffected by late summer precipitation. <br />Drainage: (Discussion of springs. seeps, overland and channel flow, underdrain construction and/or <br />discharge, integrity of 100-year 24-hour drain~e strudur~, and evidence of p~itive drainage). <br />Positive drainage is maintained on the surface of the DWP. No evidence of springs nor seeps <br />was observed. <br />Observation of Fill Construction: (Description of material, compaction, lift thicknesses, slopes, <br />and construction methods). <br />Continued drying and compaction followed by a "rolling compaction test' needs to be documented <br />prior to depositing addition refuse on the pile. Vegetation on the seeded outslopes responded <br />nicely to the late summer preapihatian and plant density is improving. <br />Page 1 of 2 <br />
