-~ i <br />~~'~~~D <br />•' ~ <br />III IIIIIIIIIIIII III ~ <br />99 <br />LEASE AGREEi~NT <br />THIS LEASE AGREEi~fENT is made and entered into this 2nd <br />day of i4arch, 1979, by and between GLEN CHAi~iBERS and DOROTHY I. <br />CHAI4BERS, whose address for purposes of this Agreement is 28584 <br />Highway 6 and 24, Rifle, Colorado 81650, hereinafter collectively <br />referred to as "Chambers," and ELAAi CONSTRUCTION, INC., a Colorado <br />Corporation, whose address for purposes of this Agreement is 1225 <br />South 7th Street, Grand Junction,~Colorado 81501, hereinafter <br />referred to as "Elam," <br />WITNESSETH: <br />Ldl-IEREAS, Chambers are the owners of the following- <br />described real property located in Garfield County, Colorado, <br />described as follows, to-wit: <br />The South Half of the Southeast Quarter <br />of the Southwest Quarter of Section 11, <br />and all of the Southwest Quarter of the <br />Southeast Quarter of Section 11 lying <br />North of the river; all of the Northwest <br />Quarter of the Northeast Quarter of <br />Section 14 lying North of the river, <br />and all of the Northeast Quarter of the <br />Northwest Quarter of Section 14 lying <br />North of the river, all in Township 6 <br />South, Range 93 West of the 6th Principal <br />:4eridian, containing 77.47 acres more <br />or less; <br />and <br />WHEREAS, the said property contains gravel, and the <br />parties desire to lease the premises so that Elam may extract <br />~" the gravel therefrom; <br />~ NOid, THEREFORE, this Agreement witnesseth that: <br />1. Chambers hereby grant unto Elam the exclusive <br />right to enter upon the real property described above and to <br />extract, process, stockpile and remove gravel to its full depth <br />therefrom in accordance with the terms hereof except those areas <br />designated as cropland. <br />2.
