Storma•ater storage apacity is in addition [o design sediment
storage and any permanen[ storage apacity. Kerr inspects all sedimentation ponds on a
' quarterly buffs. Inspections include evaluation of accumulated sediment levels relative to design
sediment storage ppacity [o verify that design stormwater storage apacity is maintained at ill
times. If inspections indiate that sediment accumulations are at or near the design xdiment
' level, Kerr removes accumulated sediment from the pond(s) R•ithin a reasonable period (typially
30 to 60 days) following the inspection. Both pond inspection reports and documentation of
pond cleanout are retained at the minesite and ue available for inspection by authoriud agenry
representatives. Based on direct observation of pond storage levels at the time discharge
occurred, [he discharge resulted from:
' C~ Rainfill or snowmelt runoff volumes less than or equil to the design 10 year, 24
hour stora
e volume
g
1 ^ Rainfall or snowmelt runoff volumes greater than the design 10 year, 24 hour
e volume
stora
g
Based on the preceding information, Kerr respectfully requests that the Water Quility Control
Division approve a stormwater exemption for ezceedance of effluent limitations consistent with
exemption and associated burden of proof provisions u outlined in Permit COG850021. It is
understood that this exemption applies only to the specified monitoring period(s), the subject
' outfill(s), and the following effluent parameters:
l~ TSS
'
Settleable Solids
^
' -/
f~ Other /~
1
