Stormv.~ater storage opacity is in addition to design udiment <br /> storage and any permanent storage apauty. Kerr inspects ill xdimentation ponds on a <br />' quarterly basis. Inspections include evaluation of accumulated xdiment levels rela[ive to design <br /> sediment storage capacity to verify that design stormwater storage opacity is maintained at all <br /> times. If inspections indiate that sediment accumulations are at or near the design sediment <br />' level, Kerr removes accumulated sedimen[ from the pond(s) 0.~ithin a reuonable period (ty?ially <br /> 30 to 60 days) following the inspection. Both pond inspection reports and documentation of <br /> pond clean-out are retained at the minesite and are available for inspection by authoriud agency <br />' reprexntatives. Baud on direct observation of pond storage levels at the time discharge <br /> occurred, the discharge resulted from: <br /> ~ Rainfall or snowmelt runoff volumes leu than or equal to the design 10 yeu, 24 <br />' hour storage volume <br />^ Rainfill or snowmelt runoff volumes greater than the design 10 year, 24 hour <br />storage volume <br />t Based on the preceding information, Kerr respectfully requests that the Rater Quility Con[rol <br />Division approve a stormwater exemption for exceedance of effluent limitations consisten[ with <br />exemption and usociated burden of proof provisions u outlined in Permit COG8i0021.
