~ 5 ~ Staff Recommendations <br />~®B- ~ SHB AGRA Project E92-7075 <br />Page 3 <br />We are willing to commit to the following if the Special Use Permit and Site Specific <br />Development Plan are approved substantially as submitted (with no additional project <br />modifications or conditions imposed by the County that Southdown deems to be economically <br />untenable with respect to the cost of the following commitments, specifically, approval of a 25 <br />year mine plan, an at grade 85 ton truck crossing of Highway 66, and successful completion of <br />the 5 year reviews): <br />1. Anon-development covenant for the life of the mine placed on the Dowe Flats <br />property, the West Dowe Flats property (except the Stone Canyon Parcel), the <br />Northwest Dowe Flats property, the South Dowe Flats property and that portion <br />of the Southeast Dowe Flats property that is within the Special Use Permit <br />boundary (see attached maps for location of these properties - a total of 2,300 <br />acres). This proposal preserves from development a large area of land for 25 to <br />28 years. <br />2. A permanent conservation easement on 10.3 acres of archaeological sites on <br />Southdown's property. <br />3. Permanent dedication, after mining and reclamation are complete, as open space <br />of [he majority of the acreage of the Northwest Dowe Flats property and the West <br />Dowe Flats property (except the Stone Canyon Parcel) provided that transfer of <br />development rights (at 1 du/35 acres) to other Southdown properties is approved. <br />This is very valuable open space at no cost to the taxpayers. <br />STAFF COMMENT 3. Any post-mining development of the mine permit area will be <br />subject to County site plan review. <br />Any post-mining development would be subject to compliance with County land use regulations <br />then in existence. The County can propose changes to its land use regulations (uniformly <br />applicable throughout the County) to gain site plan review authority on similar properties if the <br />County believes it does not currently have such authority. <br />STAFF COMMENT 4. The applicant shall revise the reclamation plan to emphasize a <br />prairie grassland landscape instead of created topographic features and wildlife habitats. <br />However, the revised plan could include limited riparian/wetland areas to replace those lost <br />to mining or the lining of the NCWCD Supply Canal. The revised plan should also <br />minimize the amount of land disturbed: no reclamation north and west of the mine area, <br />east of the "wetland zone" as shown on the Reclamation Vegetation Exhibit, or south of the <br />Supply Ditch (the northern most irrigation ditch). <br />Ln A G R A <br />Eer th & Emironmente/Group <br />
