Colorado Mined Land Reclamation Division 1313 Sherman Street Denver, CO 80203 RE: New Elk Mine Permit C-81-12 Notice of Violation C-89-004 Dear Mr. Waldron, Wyoming Fue] Company (WFC) was issued the above referenced Notice of Violation (NOV) on February 22, 1989 for failure to maintain stable diversion channels on the side collection ditches of the refuse disposal area (RDA). Steps 1 and 2 necessary to abate the violation were completed the same day the NOV was issued. Step 3 of the NOV requires the submittal of an updated operations plan for the RDA. The following information of this le[ter presents an operations plan detailing the side collection ditch constrvction, maintenance and final configuration. This plan describes specifintions for the constrvction phase and a final configuration phase. REFUSE DISPOSAL AREA OPERATIONS PLAN Tne approved RDA design and operations plan is provided on paces 2.05-24 through 2.05-35 and >=rhibit 2U of thr. permit. The final design configuration is sound for slope stability, drainage and reclamation, however, [here are some short term construction considerations that require additional clarification. Current embankment specifications are based on placing refuse in a head of hollow fill configuration vrith outslope sections at 2H:1V and a maximum height of 50 feet per section. Each section is separated by a bench of 20 feet. One long bench is proposed near the middle of the fmai configuration. Two types of ditches occur in the RDA design: Contour ditches -these ditches are placed uphill from the refuse area to divert undisturbed flow from entering the refuse area. These ditches are "on contour" and do not require erosion protection. ?' Side collection ditches -the contour ditches discharge into side collection ditches as shown in Figure 1. These ditches transport the undisturbed and disturbed area flows down the steep portions adjacent to the face of the embankment.
