CENTRAL APPALACHIA MINING, LLC <br />Munger Canyon Mine <br />Coal Mine Waste Bank Certification <br />In accordance with DMG Rule 4.10.2(2), this report is prepared to certify the coal mine <br />waste bank founding and the surface drainage systems were constructed as designed <br />and in accordance with the approved plan. <br />The design of the coal mine waste bank is presented in Volume I of the permit <br />application package, section 2.2.5. Figures 2.2-6 and 2.2-7 show the design of the coal <br />mine waste bank. Preparation of the coal mine waste bank involved; 1) removal of all <br />organic material-and topsoil; 2)-installation ofa surtace drainage-system; and 3} - -- -- <br />salvage and stockpile of coverfill material. The design of the coal mine waste bank <br />does not include a subsurface drainage system. <br />The preparation of the coal mine waste bank began in late September and was <br />completed in early November, 2004. I (J. E. Stover, P.E.) inspected the construction <br />numerous times and have a wide variety of experience in the design and construction of <br />earth fill embankments. There were no steep slopes, seepage or other visible factors <br />which would indicate a potential problem with the coal mine waste bank. <br />The construction of the coal mine waste bank is a phased project. A portion of the <br />founding was cleared of all organic material and topsoil. Topsoil was placed in the <br />designated stockpile area. coverfill was salvaged and placed in stockpile. A temporary <br />upper diversion ditch was constructed. It is not practicable or necessary during this <br />phase of the project to construct all of the design ditches. The remaining ditches will be <br />constructed as the pile expands. It was also not practicable at this time to construct the <br />upper diversion ditch at its ultimate design elevation. The design of upper diversion <br />ditch "A" is presented in Volume II, Appendix M(vii) pages M(vii)-4 & 29. The flow depth <br />is 0.4 feet and the freeboard is 2.5 feet for a total design depth of 2.9 feet. Temporary <br />upper diversion ditch "A" was constructed a total of about 2.0 feet deep with provides <br />1.6 feet of freeboard which is considered satisfactory for the temporary ditch. <br />To the best of my knowledge and belief, with the exceptions noted above, the coal mine <br />waste bank founding and drainage system were constructed in accordance with the <br />approved plan and meets the requirements of the Regulations of the Division of <br />Minerals and Geology. <br />4~ <br />R ~G d,~J~ <br />F c'a_ e <br />darroes~.
