Curry <br />Tri County Gravel <br />Post Office Box 566 <br />3569 J-75 Drive <br />Hotchkiss, Colorado 81419 <br />Dear Mr. Curry: <br />We are responding to your telephone request of May 13, 2002, <br />for a jurisdictional-determination regarding the wetland <br />vegetation (largely sedges and saltgrass) located along the edge <br />of the Phase I Affected Area (12.5 acre extraction site). The <br />property is located at the North Fork Gunnison River within <br />Section 29, Township 14 South, Range 92 West, Delta County, <br />Colorado. <br />The wetland vegetation observed by Corps representatives <br />Nick Mezei and Nathari Green on May 23 ,, 2002 within the bounds of <br />this area were either dead or in dormancy: The natural water <br />level was several feet lower than the root zone of the <br />vegetation. <br />During a previous visit to the site in April of 2002, <br />leakage from the irrigation channel was observed to enter areas <br />where wetland vegetation survived. Thereafter the irrigation <br />leakage was repaired, and the wetland vegetation and soil dried <br />up. Therefore it is concluded that the wetland area previously <br />determined to be jurisdictional within the Phase I mapping is <br />solely supported by irrigation, and is therefore not <br />jurisdictional under the Clean Water Act.
