Page 2 June 15, 2005 <br />Furthermore, personal communication with BLM representatives indicates that the harrowing of soil on <br />adjacent BLM lands is not an option. Despite these limitations, W WL has defined four potential soil <br />harrowing areas which are described in order of preference. <br />Site 1: NEl/4 NEl/4 Sec. 25, and SEll4 SEI/4 Sec. 24, T. 7 S., R 97 W. <br />This area consists of the upper-most, moderately-sloped portion of the main drainage above the <br />Research Mine bench [see Figure I (partial copy of Exhibit F)]; an area of approximately 2 acres. The <br />portion ofee drainage below (south) ofthe Logan Wash Road was previously developed and <br />reclaimed as part of mine operations. The portion above (north) of the road, although within the <br />designated affected area ofthe NEl/4 NE]/4 of Section 25 (see attached Exhibit A), was not developed <br />as part of mine activities. As shown in Figure 1, to obtain soil of sufficient quantity it may be necessary <br />to extend the soil barrow area into the SEl/4 SEl/4 of Section 24. The impacted area would therefore <br />possibly extend from a formal affected area into an area that was not previously designated as an <br />affected area. However, other affected areas lie immediately to the west (within several hundred feet) <br />along Logan Wash Road. <br />This location alone may not meet all of the soil needs required for reclamation at the mine. However, <br />its location, potential for quality material, and overall favorable aspect for mining the soil and <br />implementing reclamation qualify the site as a priority. It is estimated that at least 1,500 cubic yards of <br />soil material could be barrbwed from this area. <br />W WL requests that DMG consider the conceptual plan of harrowing soil in the Site 1 area, and address <br />whether the described area would entirely or partially be considered as affected land in accordance with <br />the mine permit. <br />Site 2:SWl/4 SWl/4 Section 18, T. 7 S. R 96 W. <br />This area consists of approximately 2.3 acres situated immediately north of former Area 12 (Figure 1), <br />as described in the permit. Area 12 has been reclaimed and is scheduled for inspection for release. As <br />shown in Figure 1, the proposed soil borrowing area would extend from the east-trending 4-wheel drive <br />track southward approximately 270 feet up the hillslope to near an existing small communications <br />facility (microwave station) owned by Solvay Chemical On the basis of soil exposure on the 4-wheel <br />drive track, the soil deposit has a lenticular geometry that pinches out to the west, east, and south. Soil <br />thickness may be as great as 4 feet in the center of the deposit. It is estimated at least 3,000 cubic yards <br />could be mined from this site. <br />According to Exhibit A, the legal description of affected lands for the mina permit area, Section 19, T. <br />7 S., R 96 W. is not included as an affected land. However, Exhibits D, E, and F clearly state and <br />show that the NW 1/4 NW 1/4 of Section 19, T. 7 S., R 96 W. will be affected by the construction of the <br />Meteorological Station. The Met Station was in fact wnstructed and the area was later reclaimed. <br />Furthermore, Exhibit F shows that a road to Area 12 was constructed in the S W 1/4 S W 1/4 Section 18. <br />This road has also been reclaimed. Based on the Legal description system of describing affected areas <br />used in the permit and use of Exhibit F, it is implied that the SW 1/4 SW 1 /4 Section 18 would qualify as <br />an affected area and harrowing of soil in this area could be addressed by the technical revision process. <br />W WL requests that DMG consider the possibility of harrowing soil in the Site 2 area, and address <br />whether the described area would entirely, partially, or not be considered as affected land in accordance <br />with the mine permit (specifically Exhibits D, E, and F). <br />
