CERTIFIED MAII. <br />RETURN RECEIPT N0.70051820 00061123 5232 <br />July 13, 2007 <br /> <br />Mr. Jim Dupler AGGREGATE <br />Division of Reclamation, Mining & Safety <br />1313 Sherman Street, Room 215 INDUSTRIES <br />Denver, CO 80203 <br />Re: Permit No. M-1989-120 -Platte Valley Operation - 112c Annual Report and Map <br />Dear Jim: <br />Enclosed is Check No. 224349 in the amount of $688.00 together with the annual report form and a <br />drawing for the above-referenced permit. Mining has been completed in all cells/phases of the Platte <br />Valley operation except the processing plant area and concrete batch plant site (CelUPhase 5). These <br />areas will continue to operate with material being conveyed from Aggregate Industries' adjacent <br />Wittenberg Lakes operation (Permit M-2004-051). It is anticipated that mining within Phase 5 areas will <br />not occur until all material from the Wittenberg site has been processed through the Platte Valley plant. <br />All sloping has been completed around the lake in the southern half of the site and the lake has filled with <br />groundwater. Phase 2, except for approximately 2 acres on the south end, and the groundwater lake <br />slopes were seeded above the anticipated final lake elevation in Spring 2006. It is anticipated that the <br />backfilled azea at the south end of Phase 2 will be seeded during the current permit year. Backfilling of <br />Phase 4 will continue throughout the life of the mine in accordance with the permit reclamation plan and <br />the import inert fill notice approved by the Division on November 15, 2005. <br />Backfilling and grading of slopes in Phase 3 is also projected for the current permit year.
