<br /> <br />w~,~ s•,my •,.d s.~ en,~, as Fs.mP^«.rsv~r <br />1.0 OVERVIEW AND INTRODUCTION <br />• Section 34-32-10 & 3 (3.5)(a) defines "Designated Mining Operation" a:. operation at <br />which: <br />(I) Toxic or acidic chemicals used in extractive metallurgical processing are present <br />on site or; <br />(II) Acid- or toxic-forming materials will be exposed or disturbed as a re<.,ult of mining <br />operations. <br />• Subpart (b) refers to Section 34-32-112.5 for identification of types of designated mining <br />operations: "Such mining operations exclude operations which do not use toxic or acidic <br />chemicals in processing for purposes of extractive metallurgy and which vrill not cause <br />acid mine drainage." <br />• Exempt under Subpazt b, but EFN also considered broader issue of whether or not the <br />operation mines pose any significant level of risk to human health or the environment. <br />• Review of the available data supports the conclusion that the level or d~;gree of any <br />environmental concern associated with these mines is minitnal and temporary in nature. <br />• To allow the Division to undertake the same exercise, EFN prepazed a draft summary of <br />the environmental information considered. <br />HIUSFASUffIMWPAIXRUElTEA59SwSUNSUN PRE <br />PRge I <br />
