~~ M ~
Agile Stone Systems, Inc.
6435 S. Pontiac Ct., Englewood, CO 801 I I
(303) 741-2556
(303)721-0293 Fax
January 7, 2000
Division of Minerals and Geology
Attn: Larry Oehler
1313 Sherman Street
Denver, CO. 80203
Dear Lany,
Re: Annual Report Permit No. M-1997-054
Due to the railroad dispute with the UPRR and subsequent arbitration ending on September 10,
1999, Agile did not start operations until this delayed latter date. There has been no change in
plans for disturbance and the start up operations sequence. The original plan for 1999 estimated
about 92 acres of disturbance. This has been limited to about 34 acres (marked in red on enclosed
P2 map) due to the delayed start. Roads to the sandstone mine and granite quarry areas were not
started. The quarry area itself was not stazted. Portions of the eastern parts of the plant area,
topsoil stockpile and Gravel Area B were not yet disturbed as planned. The permanent berms on
the southern part of the property were also not started due to the delayed start. Each of these
areas is planned to be disturbed in 2000 as originally planned for 1999 (marked in yellow and
"2000" noted on P2 map) causing an incremental acreage distwbance of 58 acres to equal the
original planned disturbance of about 92 acres. If the sandstone quarry is opened as planned in
year 2, it's original planned 3 acres would also be disturbed as planned. No reclamation has
occurred due to the late start up and limited initial disturbance. Past reclamation cost estimates
appeaz to be representative and more than capable of handling current and planned disturbance as
originally planned.
No herbicides were used on the property to date and we have been expecting a response from the
county weed control boazd for several months answering our request to limit our weed control to
biological controls. I have inquired as to why no response has been obtained and will continue to
follow this question until I get a response. When I get a response, I will send you a copy.
Therefore, we have not tested for any herbicides but are starting to test for some base line
information of bacteria, nitrate/nitrite and pH.
I don't think the variance in well and spring measurements are significant due to the changes in
weather with the dry Spring and wet subsequent Summer and Fall. Also, the Corral well shows
anomalous results due to the use of the well water in the Spring drawing its level down and then
not using it at all in the Fall. Water records aze enclosed.
Sincerely,
/Yb~l!'
Mitch Albert, Ph.D.
President
