Lochhead <br />Eaeculive Director <br />Michael 9. long <br />Division Dneclor <br />C.R.S. 34.32.5-1 1 61311a1 end Ibl, 1989 Supp. and Permit No. M-63.037 require you to submit to the Division <br />of Minerals and Geology 5225.00 in annual fees and an annual report an err before May 31 of each year. <br />• As of the date of this letter the Division has not received your annual fee and report for May 31. 1996. <br />Therefore, you are in violation of the above cited statute and the provisions of Permit No. M-83-037. <br />Pursuant to C.R.S. 34-32.5.124 the Mined Land Reclamation Board hereby assesses Notice of Violation No. <br />M-96-039, Civil Penalties in the amount of 5225.00, and Notice and Order to Cease and Desist from ALL <br />mining related activities associated with Permit No. M-83-037. <br />NOTE: NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED TO ANY OPERATOR WHO IS <br />CURRENTLY FOUND TO BE IN VIOLATION IN THIS STATE (C.R-S- 34325-120) UNTIL THE VIOLATION IS <br />ABATED. <br />If you fat to submit your annual fee, annual report, and the Civil Penalties assessed to the Division by <br />Septemher 23, 1996, this matter will he heard at a Formal Puhlic Hearing hefare the Mined Land <br />Reclamation Board for consideration of permit revocation and forfeiture of your financial warranty <br />Corporate Surety No. 8031 in the amount of 35,000.00, at the September 26, 1996 Board meeting. If you <br />submit all past due annual fees, reports, and the Civil Penalties by September 23, 1996, this matter will be <br />withdrawn from Board consideration. <br />IN ORDER TO AVOID PERMIT REVOCATION AND BOND FORFEITURE, PLEASE SUBMIT 5225.00 FOR <br />ANNUAL FEES DUE AND 5225-00 FOR CIVIL PENALTIES ASSESSED IFOR A TOTAL OF 5450.001, AND <br />YOUR ANNUAL REPORT BY September 23, 1996. <br />The Mined Land Reclamation Board Meeting will he held on Septemher 26, 1996, in Leadville, at the National <br />• Mining Hall of Fame -Convention Center, 120 W 9th St., (use the 10th.
