As a result of this review we have the following questions or comments. <br />Included with the submittal was an Annual Inspection Report for the Refuse Disposal <br />Area (RDA) pond. Is this a copy of the report to meet the requirements of 30 CFR <br />77.216-3? For which state program rule does this report comply with? <br />2. The information submitted for the RDA include the routine quarterly inspection reports <br />for the second and third quarters of 1999, which satisfy the requirements of Rule <br />4.09.1(11)(a). Also during the second quarter, a specific inspection was conducted on <br />June 29, 1999, by Mark Gray of CTL(ihompson Consulting Engineers, to evaluate the <br />reconstructed surface drainage system at the RDA. The inspection included comparison <br />of the as-built configuration and the specific design included in Exhibit 20 of the permit. <br />Another specific inspection was done during the third quarter evaluating the revegetation <br />of the fourth outslope of the RCA. These two specific reports satisfy the additional <br />requirements of Rule 4.09.1(11)(a) for the RDA. <br />3. The information submitted for the DWP include the routine inspections for the second <br />and third quarters of 1999. Noted in the second quarter report is reference to page 3 of <br />3 of job #28170 performed on June 25, 1999 by CTL/Thompson. This specific reference <br />cites the need for drying and compaction testing of the sediment pond materials placed <br />on the DWP over the course of the last field season. These two reports satisfy the <br />additional requirements of Rule 4.09.1(11}(a) for the DWP. <br />Please respond to question #1 above.
